The five candidates receiving the highest number of votes cast will be the nominees submitted by the Tenth Judicial District Bar to the governor for his consideration. 5. Results of Election. Following the meeting, I will communicate to Governor Cooper the names of the five candidates receiving the most votes along with the number of votes received by each. The Tenth Judicial District Bar members will be notified by email of the names of the five nominees, and the names will also be listed on the WCBA and Tenth J.D. Bar website and in the next broadcast email to the entire Tenth Judicial District membership.

"Before I go, I would like to speak to you from the heart on an issue of great significance to me.

As all of you know who know me, I have committed a significant portion of my professional life to working with people living in poverty. 

It is because it is an issue that is deeply personal and important to me – my mother grew up in deep poverty.  She was a victim of child abuse and domestic violence by her husband.  It was only because of her extraordinary personal strength and the teachers and mentors that I had during my childhood that I went to college and became a lawyer. 

I know from my mother’s own experience that all poor people are not poor because of bad personal choices.   Some are – but not all.  I also know that many people in our society take advantage of people who are poor – from insurance salesman selling fake insurance policies to elderly people to landlords demanding sex from tenants unable to pay rent.

It is for this reason that I feel called to devote my time and influence to serving low income people. 

There is one legal aid attorney available for every 6,000 low-income people compared to 1 to 400 in the general population.   And federal and state funding for legal aid is shrinking, further widening this divide.

I believe that it is unacceptable that poor people cannot meaningfully access the courts.  And, I will continue to spend my time, my energy and my influence to impact this problem.

There are approximately 500 lawyers in this room today.  If we each contributed just one billable hour to Legal Aid, we would raise $150K. 

If the more than 5,000 members of our bar did the same, we would raise $1.5M.

We can no longer depend exclusively on public resources to fund Legal Aid programs.  So, today, I ask you make a commitment to Legal Aid, to poor people in our community and to our justice system, that you will contribute the value of one billable hour each year to Legal Aid or volunteer to take just one pro bono case.

Lawyers are uniquely positioned to address the problem of access to justice.  Poor people do not have the power to advocate meaningfully on this issue – but we do have that power.  And we must use it.

A special election of the Tenth Judicial District Bar will be held Tuesday, August 29 from 8 a.m. to 2 p.m. at the Wake County Justice Center, Courtroom 102. The purpose of this election is to select five nominees whose names will be forwarded to Governor Roy Cooper for consideration for the District Court Judge position resulting from Judge Jacquelyn Brewer's retirement. 

Each member of the Tenth Judicial District Bar who resides in Wake County is entitled to vote for up to five candidates, but may not cumulate votes on the same ballot. Voting shall be limited to those attorneys licensed to practice in North Carolina, who reside in Wake County and are members in good standing of the Tenth Judicial District Bar per NCGS §84-16. There is no absentee ballot available.

This is formal notice of an election meeting of the Tenth Judicial District Bar to be conducted Thursday, March 23 to select nominees for consideration for the District Court Judge position, which opened when Judge Vince Rozier was named to a Superior Court position.  We will select five nominees to submit to Governor Roy Cooper for his consideration in filling this position. The election will be held at the Wake County Justice Center.  Voting will be available from 8 a.m. to 2 p.m. Only Tenth Judicial District members who reside in the District are eligible to vote.
                
1.        Location of Election Meeting. The election will be held in Wake County Justice Center, Courtroom 102, on the first floor.  

2.       Candidate Qualification and Notification.  To qualify as a nominee for this position, a member must be a resident of and be duly authorized to practice law in the Tenth Judicial District, which consists of Wake County.  Any such qualifying member who wishes to be a candidate for this judicial seat must notify me of his or her intention in writing and provide proof of residency, such as a copy of a driver’s license.  Notification should be emailed, mailed or delivered to the following address:

Tenth Judicial District Bar Members:  

In 2013 Charles Caldwell was appointed to the position of Tenth Judicial District Public Defender. His initial four-year term expires June 30, 2017.  Mr. Caldwell is eligible for reappointment. Pursuant to the rules of the Commission on Indigent Defense Services (click here to see the Regulations), we may be required to hold an election of the Tenth Judicial District Bar to provide the names of up to three nominees for consideration for this position.
